Introduction

Welcome to the "XingXing" APP (hereinafter referred to as the "App" or "We"), developed and operated by XingXing Intelligent International Limited (hereinafter referred to as "We", "Us", or "Our").

By accessing or using our App, you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully, especially the clauses in bold. If you do not agree to these Terms, you must not access or use our services.

1. Eligibility and Account Registration

1.1 Age Restriction: You must be at least 18 years old to use this App. By using our services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

1.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials. You agree not to share, sell, rent, or transfer your account to any third party. We reserve the right to suspend or terminate accounts that are suspected of being compromised or used fraudulently.

1.3 Accurate Information: You agree to provide accurate, current, and complete information during the registration process.

2. AI Avatar Services and User Responsibility

2.1 Service Definition: The App provides AI-powered social features, including AI Avatar generation, smart matching, and AI-assisted chatting.

2.2 User Responsibility: You acknowledge and agree that your "AI Avatar" acts as your digital agent. You are fully responsible for all content generated, messages sent, and actions taken by your AI Avatar. Any violation of these Terms by your AI Avatar will be treated as a violation by you.

2.3 AI Content: You understand that AI-generated content is based on algorithms and may not always be accurate or representative of your true intentions. You have the right to manage, edit, or disable your AI Avatar's features at any time via the App settings.

3. User Conduct and Community Guidelines

You agree not to use the App for any illegal or prohibited purpose. You must not:

Post, upload, or share content that is defamatory, obscene, pornographic, vulgar, or offensive.

Engage in hate speech, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, or disability.

Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

Use the App to send spam, unsolicited advertising, or engage in any form of commercial solicitation without our prior written consent.

Use automated systems (e.g., bots, scrapers) to access the App or interfere with its normal operation.

Attempt to gain unauthorized access to other users' accounts or the App's computer systems.

4. Payments, Subscriptions, and Virtual Currency

4.1 In-App Purchases: Certain features of the App, such as premium memberships and virtual currency ("Star Coins"), require payment. All purchases are final and non-refundable, except as required by applicable law or the policies of the relevant app store.

4.2 Subscriptions: If you purchase a recurring subscription (e.g., weekly, monthly), it will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the renewal date. You can manage or cancel your subscriptions through your Apple ID account settings or Google Play account settings.

4.3 Virtual Currency: "Star Coins" are virtual items that can be purchased for use within the App. They have no cash value, are not redeemable for cash, and cannot be transferred or sold to other users.

4.4 Third-Party Stores: You acknowledge that your purchases and subscriptions are governed by the terms and conditions of the respective app store (e.g., Apple App Store, Google Play Store).

5. Intellectual Property

5.1 Our IP: All content, features, and functionality of the App (including but not limited to text, graphics, logos, software, and AI algorithms) are the exclusive property of XingXing Intelligent International Limited and are protected by international copyright, trademark, and other intellectual property laws.

5.2 User Content: By posting content on the App, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and improving the App.

6. Disclaimers and Limitation of Liability

6.1 No Warranty: THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE APP, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

6.2 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE LAST SIX (6) MONTHS.

6.3 User Interactions: We are not responsible for the conduct of any user, online or offline. You are solely responsible for your interactions with other users. We recommend that you exercise caution and use common sense when interacting with others.

7. Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

8. Governing Law and Dispute Resolution

8.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law principles.

8.2 Dispute Resolution: Any dispute, controversy, or claim arising out of or in connection with these Terms shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The seat of arbitration shall be Hong Kong. The number of arbitrators shall be one. The language of the arbitration shall be English.
